– Government can approach president to amend the earlier Presidential order

New Delhi, 30 September, 2015: Supreme Court today dismissed the petition of Government of United Andhra Pradesh over the Common Service rules for teachers. The Apex Court suggested the government to send a proposal to amend the presidential order to get integration of services for pnchayat raj teachers and Government teachers.

“we do not want to interfere the order passed by high court. so the civil appeal is dismissed. Government can approach President of India seeking the amendment for earlier Presidential Order to integrate service rules for Panchayat raj teachers and Government employees,” Said the bench, Comprising of Justice Jagdish Sing Kehar and Justice R.Bhanumati.

Court Also said that Government may act as early as possible to find a channel to give promotions for PR teachers.

PR teachers strength is about 94% and Government teachers strength is only 6 %. Government teachers services were notified as per Article 371D in presidential Order, where as PR teachers service was not notified in that order. So Government teachers argued that their service is zonal, it can not merged with Local body (PR) teachers without consent of President. So court also found the same and stated that according to the rules government can not unified the rules.
